These Terms & Conditions (“Terms”) apply to your use of the Site and any purchase of artwork, prints, or commissioned work from Martina Radulovic (“I”, “me”, “my”). By using the Site or placing an order, you agree to these Terms. Please read them carefully.

2. Use of the Site
You may use the Site for personal, non-commercial purposes only. You agree not to:
- Use the Site in any unlawful way or for any unlawful purpose
- Copy, reproduce, modify, distribute, or republish any content from the Site without my written permission
- Attempt to gain unauthorised access to the Site, its servers, or related systems
- Use the Site in any way that could damage, disable, overburden, or impair it
I reserve the right to restrict access to all or part of the Site at any time, without notice.
3. Intellectual property and copyright
All artwork, prints, photographs, text, images, and other content displayed on the Site are the original creative works of Martina Radulovic and are protected by UK and international copyright laws. All rights are reserved.
This means that:
- You may not download, copy, reproduce, print, share, or use any images of artwork from the Site without my prior written permission.
- Purchasing an original artwork or print does not transfer copyright. The copyright in the work remains with me as the artist. You receive ownership of the physical object only.
- You may not reproduce purchased artwork or prints in any form (including digital, printed merchandise, or commercial use) without my written permission.
- You may not use my work to train, fine-tune, or otherwise inform any artificial intelligence, machine learning, or generative AI model.
Personal, non-commercial sharing on social media is welcome, provided the work is credited clearly to Martina Radulovic and not altered.
4. Purchasing artwork and prints
4.1 Order process
When you place an order through the Site, you are making an offer to buy. A contract is formed when I send you an order confirmation email. I reserve the right to refuse any order, for example, if an item is unavailable, there is a pricing error, or I am unable to verify payment.
4.2 Pricing
All prices are shown in [£ GBP / specify currency] and include VAT where applicable. Shipping costs are shown at checkout before you confirm your order. Despite my best efforts, occasional pricing errors may occur — if a clear error is identified before dispatch, I will contact you, and you may choose to confirm the order at the correct price or cancel it.
4.3 Payment
Payment is taken at the point of order through a secure third-party payment provider (such as Stripe or PayPal). I do not store full payment card details.
4.4 Availability
Each original artwork is unique and offered for sale only once. Prints may be available as open or limited editions; edition details will be stated on the product page where applicable.
5. Shipping and delivery
I aim to dispatch orders within 10 working days of payment unless otherwise stated. Delivery times depend on destination and shipping method, and will be confirmed at checkout.
Risk of loss or damage passes to you when the parcel is delivered to the address you provided. Please inspect your order on arrival and contact me within 14 days if it arrives damaged.
For international orders, you are responsible for any customs duties, import taxes, or fees charged by your country.
6. Cancellations and returns
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer based in the UK or EU, you have the right to cancel your order within 14 days of receiving it, for any reason.
6.1 How to cancel
To cancel, please email me at info@martinaradulovic.com within 14 days of receiving your order. You then have a further 14 days to return the item.
6.2 Condition of returned items
Items must be returned unused and in their original condition and packaging. You are responsible for return shipping costs and for ensuring the work is packaged carefully and adequately insured. I cannot accept responsibility for items damaged or lost in return transit.
6.3 Refunds
Once I receive the returned item in original condition, I will refund the purchase price (including standard delivery costs to you) within 14 days, to the original payment method.
6.4 Exceptions
The right to cancel does not apply to:
- Commissioned or personalised work made to your specifications
- Items that have been altered or modified at your request
For commissioned work, separate terms will be agreed in writing before I begin.
7. Faulty or damaged items
If your item arrives faulty, damaged, or not as described, please contact me within 14 days of delivery with photos. Under the Consumer Rights Act 2015, you may be entitled to a repair, replacement, or refund. Nothing in these Terms affects your statutory consumer rights.
8. Commissions
If you commission a bespoke artwork from me, a separate written agreement will set out the scope, timeline, payment schedule, and copyright terms. A non-refundable deposit is typically required before work begins. Commissioned works are excluded from the 14-day cancellation right above.
9. Limitation of liability
To the fullest extent permitted by law:
- The Site and its content are provided on an “as is” basis. I make no warranties about its accuracy, completeness, or availability.
- I am not liable for any indirect, incidental, or consequential losses arising from your use of the Site.
- Nothing in these Terms limits or excludes my liability for death or personal injury caused by my negligence, fraud, or any other liability that cannot be limited under UK law. Your statutory rights as a consumer are not affected.
10. Privacy
Your use of the Site is also governed by my Privacy Policy, which explains how I collect and use your personal data.
11. Changes to these Terms
I may update these Terms from time to time. The “Last updated” date at the top shows the most recent revision. The Terms that apply to your order are those in force at the time you placed it.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you live in Scotland or Northern Ireland, in which case the courts of your home country will also have jurisdiction.
